Terms and conditions

Introduction

These terms and conditions set out the contractual relationship between the seller – THE FRENCH TOCANTES INC., and a Customer using the seller’s website at leforbansecuritemer.com

The seller (hereafter referred to as ‘LF’), as described in the legal notice, is the distributor of ‘LE FORBAN * SECURITE MER’ watches.

The Customer and LF are hereafter referred to as ‘the Parties’.

These Terms and Conditions are applicable solely to non-commercial, private individual Customers.

The Customer acknowledges having read and understood the following Terms and Conditions and agrees to accept them unreservedly.

LF reserves the right to amend or update the Terms and Conditions without prior notice, publication of a new version of the Terms and Conditions on the website renders them valid at the moment an order is placed.

 

Article 2 – Selling price

Prices are shown in Euros, inclusive of Value Added Tax at the prevailing rate, currently 20%, excluding any shipping or handling costs.  The actual price of the watch is that showing at the moment the order is placed.  Should LF alter the price of any of its products, any change will only become valid if already published on the website at the time an order is placed.

 

Article 3 – Proof of transaction

Exchanges between LF and the Customer will be kept for the authorised legal period, as will all proofs of communication, of orders and of payments.  This data may be used in the case of any dispute arising regarding the proof and details of a transaction.

 

Article 4 – Delivery

LF products are delivered to the address indicated by the Customer on the online order form.  The Customer is solely responsible for the information entered on the order form.  In the case of an erroneous or incomplete address, any return shipping costs will be charged to the Customer.

At the moment of final delivery, the Customer must inspect the parcel externally and, if necessary, report any damage to the delivery company and keep proof of having done so.  In the case of an issue with the product ordered – such as missing items, damage or breakage, the Customer should notify the transport company and inform LF within 48 hours at the following e-mail address leforbansecuritemer@gmail.com

The Customer must inform the transport company by registered letter of any issue as mentioned above, within 48 hours of delivery at the latest, and forward a copy of the claim to LF.

Should the Customer wish to return an item or items to LF, this must be done within 14 days of initial delivery, or the right to return item may be forfeit.   It is an obligation that returns be made in the original packaging, together with all accessories, the user manual, the box, the guarantee card, straps and any other items originally contained in the parcel.  Signature for receipt of the parcel or failure to make a claim with 48 hours will be deemed to indicate full acceptance of delivery and condition of the parcel.

 

Article 5 – Guarantee

LF undertakes to repair or replace any item which is defective or damaged in the course of normal use, within the legal guarantee period of 2 years.

The Customer should make LF aware of any issue, by e-mail sent to the following address leforbansecuritemer@gmail.com  in order that LF can determine the action to be taken and request the return of the item in question for repair or exchange.  After a period of 30 days following initial delivery, any return shipping costs are the responsibility of the Customer.  Subsequent shipping costs to return the item to the Customer are the responsibility of LF.  Any return under guarantee must be accompanied by the Warranty or a copy of the purchase invoice, available in the Customer’s account on the website.

The following are specifically excluded from the guarantee:

LF reserves the right to refuse to undertake repairs free of charge for damage due to the above reasons.   Should any repairs be necessary which are not be covered by the guarantee, LF will send an estimate for the work to the Customer.

 

Article 6 – Responsibility

Products sold by LF comply with the description shown on the website and with prevailing French legislation.  LF will not be held liable for non-compliance with legislation in the country where the products are sent.  It is the Customer’s responsibility to ensure that importing and/or using any products ordered are authorised in the destination country.

LF will only accept liability in the case of proven fault.  In any event, LF’s liability, if admitted, shall not exceed the price paid for the defective product and provided payment has been made in full by the Customer, proof of said payment being the responsibility of the Customer.

The Customer acknowledges that all intellectual property rights regarding products, brands, logos, designs, engraving, photographs and films remain fully and wholly the property of LF or its agents.  The Customer undertakes not to utilise, fully or partially, the aforesaid elements for personal use or allow use by a third party.

 

Article 7 – Cooling off period

Customer orders are covered by the provisions of Law n° 2014-244 (the so-called Hamon Law) regarding consumers and distance selling.   In the case of a change of mind, the product must be returned within 14 days of delivery and at the Customer’s expense.

 

Article 8 – Applicable law – disputes

This contract is subject to French law.  In the case of a dispute, if an amicable solution cannot be found, French courts shall have sole jurisdiction.
